Terms of Use
These terms are an agreement between you and the operator of the McFarm platform ("McFarm", "we", "us"). By creating an account, signing in, or using a farm's shop you agree to them. If you use McFarm on behalf of a farm or business, you confirm you may bind it to these terms.
1. What McFarm is
McFarm is a record-keeping and management tool for farms: livestock, health, crops, processing, inventory, tasks, sales, finances and pay. It works from the information you and your team enter. It does not check that information, and it does not replace professional judgement.
2. Not professional advice
Nothing in McFarm is veterinary, agronomic, financial, tax, accounting, employment or legal advice. Health scores, alerts, margins, cost-per-unit figures, pay calculations and every other output are arithmetic on the records you entered. Decisions about treating an animal, selling a crop, paying a worker, pricing a product or filing taxes are yours, and you should confirm them with a qualified professional where it matters. Financial figures in McFarm are management information; your accountant's books remain the record for tax.
3. Accounts and roles
- You must give accurate details and keep your password private. You are responsible for everything done under your account.
- A farm owner decides who joins the farm and with what role, and is responsible for their team's use of the service, including what workers are told about the records kept on them.
- You must be 18 or older to create an account.
- We may suspend or close an account that breaks these terms or puts the service or other users at risk.
4. Your records
The records a farm enters belong to that farm. You give us the right to store, process, display and back them up as needed to run the service, and to show in a farm's public shop only what the farm chooses to publish. You are responsible for having the right to enter the information you enter, including information about other people.
You also allow us to use the farm's animal and crop production records, with the farm's identity removed and grouped by district or village, for our own research to improve McFarm, as described in the Privacy Policy. This never includes people's names, pay, contacts, prices or the farm's location, and the results are not shown to other farms. On the free Backyard plan this contribution is a condition of the plan. On the Homestead and Estate plans you may switch it off in Settings for records from that point on.
5. Acceptable use
Do not use McFarm to break the law, to access another farm's data, to enter false records intended to mislead, to send spam through a farm's shop, to probe or overload the service, or to upload content that is unlawful or infringes someone's rights.
6. Shops, orders and payments
A farm's shop is the farm's own store. A purchase made through it is a contract between the buyer and that farm, not with McFarm. The farm is responsible for the product, its description, delivery and any refund. Payments are processed by third-party providers under their own terms, and card details never pass through McFarm. Platform subscription fees, where charged, are set out in the app and may change with notice.
7. Availability and changes
We aim to keep McFarm available and to back it up regularly, but we do not promise uninterrupted service. We may change, add or remove features, and we may take the service down for maintenance. Keep your own copies of anything you cannot afford to lose; the export functions exist for that reason.
8. No warranty
McFarm is provided "as is" and "as available". To the fullest extent permitted by law we make no warranty, express or implied, about the service, including that it is accurate, complete, fit for a particular purpose, error-free or secure, or that its outputs will lead to any particular farming, financial or business result.
9. Limitation of liability
To the fullest extent permitted by the laws of Belize:
- We are not liable for any indirect, incidental, special or consequential loss, or for loss of profit, revenue, business, goodwill or data, however caused.
- We are not liable for loss of or harm to animals, crops, products, equipment or people, or for any decision you make or do not make, based on information shown in McFarm.
- We are not liable for the acts or omissions of your team members, of buyers or suppliers, of payment providers, of Microsoft, or of any other third party.
- Our total liability to you for all claims arising from the service in any 12-month period is limited to the fees you paid us for the service in that period, or BZ$100 if you paid none.
Nothing in these terms excludes liability that cannot be excluded by law, such as for fraud.
10. Indemnity
You will compensate us for claims, losses and costs arising from your breach of these terms, your records, your farm's shop, or your treatment of the people whose information you enter.
11. Ending the agreement
You may close your account at any time. We may end or suspend the service for breach, non-payment, legal requirement, or if we stop offering McFarm, with reasonable notice where possible. Sections 2, 4, 8, 9, 10 and 12 survive.
12. Governing law
These terms are governed by the laws of Belize, and the courts of Belize have exclusive jurisdiction over any dispute, without prejudice to any mandatory consumer protection you are entitled to where you live.
13. Changes to these terms
We may update these terms. The date at the top changes when we do, and material changes are announced in the app. Continuing to use McFarm after a change means you accept it.
